Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your use of Boske — the boske.dev website, the hosted workspace at app.boske.dev, the Boske desktop application, and related products and services (collectively, the "Services") operated by Boske, an independent brand of Canopy Studio. By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you use the Services during our Alpha phase, you also accept the risks described in our Alpha Disclaimer If you do not agree, do not use the Services.

2. Description of Services

Boske is a private AI workspace for teams that need control over where their data lives. Depending on your plan, the Services may include AI-assisted chat, document workflows, retrieval-augmented generation (RAG), voice features, agents, and related tools, offered in local, EU-hosted cloud, hybrid, team, enterprise, or on-premise deployments. Boske is currently offered as Alpha software: features may be incomplete, unstable, or change without notice. We may modify, suspend, or discontinue any part of the Services at any time.

3. Eligibility, Accounts, and Subscriptions

You must be at least 18 years old and able to enter a binding contract. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization. When creating an account, you must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. Paid plans, seats, and licenses are governed by the tier selected at purchase and may include usage limits. Fees are billed as described at checkout or in your order; unless required by law, fees are non-refundable once a billing period has started.

4. Intellectual Property

The Services — including software, branding, documentation, and website content — are owned by Boske or its licensors and protected by intellectual property laws. Except for the limited licenses expressly granted in these Terms and your own User Content, no rights are granted to you.

5. Boske Software

Subject to these Terms and your subscription tier, Boske grants you a limited, non-exclusive, non-transferable seat license to install and use the Boske desktop application on devices you control, up to the number of seats purchased under your plan. This license is for your internal business or personal use only.

You may not sublicense, resell, redistribute, or publicly host the Boske desktop application. You may not reverse engineer or decompile the software except where applicable law expressly permits. Each seat license is assigned to a single user or device as described at purchase.

Your seat license ends when your subscription expires, is cancelled, or we terminate your access for breach of these Terms. Upon termination, you must stop using and uninstall the Boske desktop application.

6. User Content and AI Outputs

You retain ownership of content you submit to the Services ("User Content"). We do not use your User Content to train foundational AI models. How we collect, process, and protect personal data is described in our Privacy Policy and Data Promise. You are responsible for ensuring you have the rights to submit User Content and that your use complies with applicable law.

AI-generated outputs may be inaccurate, incomplete, or inappropriate. Outputs do not constitute legal, medical, financial, or other professional advice. You are responsible for reviewing outputs before relying on or acting on them.

7. Acceptable Use

You agree not to:

  • Use the Services for unlawful purposes or in violation of applicable regulations
  • Infringe intellectual property, privacy, or other rights of others
  • Upload malware, attempt to disrupt the Services, or overload our infrastructure
  • Bypass security, licensing, or usage controls
  • Scrape, harvest, or systematically extract data from the Services without authorization
  • Use the Services to harass, abuse, or harm others
  • Misrepresent AI-generated outputs as human-written professional advice

8. Limitation of Liability

To the maximum extent permitted by law, Boske and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the fees you paid us for the Services in the twelve (12) months before the claim, or €100 if you paid no fees. The Services are provided "as is" during the Alpha phase without warranties of any kind, except where such exclusions are prohibited by law.

9. Termination

We may suspend or terminate your access to the Services for breach of these Terms, non-payment, or to protect the Services or other users. You may stop using the Services at any time. Provisions that by their nature should survive termination — including intellectual property, limitation of liability, and governing law — remain in effect.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated date and, where appropriate, notified by email to the address associated with your account. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. Where mandatory consumer protection laws in your country of residence grant rights that cannot be waived by contract, those rights remain unaffected. For enterprise or on-premise customers, a separate written agreement may prevail where it explicitly conflicts with these Terms on commercial terms.
